LEGAL NOTICE

1. Scope and Applicability

This Legal Notice applies to all services, transactions, communications, and representations made by Amkor Travel & Tours Inc. (“AMKOR”), whether conducted through its official website, online booking systems, social media platforms, messaging applications, email correspondence, digital advertisements, printed materials, physical offices, or authorized representatives.

All promotional materials, quotations, travel packages, fare advertisements, and service descriptions are provided for general informational purposes and remain subject to availability, supplier confirmation, booking restrictions, and applicable Philippine laws and regulations.

2. Nature of Services and Intermediary Capacity

AMKOR operates strictly as an intermediary, booking agent, and documentation facilitator between clients and independent third-party service providers including, but not limited to, airlines, hotels, cruise operators, land tour operators, transport providers, travel insurance companies, embassies, visa application centers, courier companies, payment processors, global distribution systems (GDS), consolidators, and accredited partner travel agencies locally and internationally.

AMKOR does not own, manage, operate, or control these third-party entities. The contractual relationship for airfare, accommodation, tour packages, cruise services, insurance policies, and visa-related services exists directly between the client and the respective supplier upon booking confirmation and payment.

Each service component is governed by its own applicable terms and conditions, fare rules, cancellation policies, booking classifications, operational restrictions, and regulatory requirements imposed by the relevant supplier. Clients are deemed to have accepted such supplier-specific terms upon confirmation and payment.

3. Legal Capacity and Adult Transactions

All transactions with AMKOR must be made by individuals who are legally capable of entering into binding contracts under Philippine law. By submitting personal information, requesting bookings, confirming services, or making payment, the client represents and warrants that he or she is at least eighteen (18) years of age and possesses full legal capacity pursuant to the Civil Code of the Philippines.

Bookings involving minors must be made by a parent, legal guardian, or authorized adult who assumes full contractual and financial responsibility.

4. Electronic Communications and Binding Consent

In accordance with the Electronic Commerce Act of 2000 (Republic Act No. 8792), electronic documents, online confirmations, digital communications, chat-based approvals, email confirmations, and electronic payments have the same legal effect as written and signed documents.

Voluntary submission of personal information, passport copies, identification documents, financial records (where required for visa processing), or other required data constitutes lawful consent for processing for legitimate travel-related purposes.

Confirmation of bookings, acceptance of quotations, acknowledgment of terms, or agreement to proceed through electronic communication or payment completion shall be considered valid and binding consent, even in the absence of a physically signed contract.

5. Data Privacy and Lawful Data Sharing

AMKOR processes personal data in compliance with the Data Privacy Act of 2012 (Republic Act No. 10173), its Implementing Rules and Regulations, and relevant issuances of the National Privacy Commission.

Personal data collected may be processed for purposes including booking confirmation, supplier coordination, visa facilitation, compliance with airline and government requirements, fraud prevention, and fulfillment of contractual obligations.

Where necessary to perform services, AMKOR may share relevant personal data with airlines, hotels, embassies, visa centers, courier services, insurance providers, payment processors, government agencies, and accredited partner agencies. In cases where structured processing is required, AMKOR implements appropriate safeguards, including Data Sharing Agreements (DSA) or Data Processing Agreements (DPA), to ensure lawful processing, confidentiality, and security compliance.

6. Pricing, Availability, and Promotional Restrictions

All services are subject to availability at the time of confirmation. Promotional fares, discounted packages, limited-slot group departures, early-bird rates, and special campaign offers may carry specific restrictions, including non-refundability, fixed travel periods, and cancellation penalties imposed by suppliers.

Exchange rate fluctuations, fuel surcharges, government taxes, and supplier adjustments may affect final pricing. Prices are not guaranteed until full payment is received and written confirmation is issued.

AMKOR reserves the right to correct typographical, clerical, or system-generated errors in pricing or service descriptions.

7. Visa Services Disclaimer

Visa assistance services are limited to documentation coordination and facilitation. Visa approval, denial, delay, or additional requirements remain solely at the discretion of the relevant Embassy, Consulate, or Visa Application Center. AMKOR does not guarantee visa approval under any circumstance.

Embassy fees, visa center charges, biometrics fees, courier fees, and government filing fees are generally non-refundable once submitted.

Where necessary due to appointment limitations, operational constraints, or regulatory requirements, AMKOR may coordinate with accredited partner agencies or authorized third-party processors to fulfill visa-related services, subject to their respective policies and limitations of liability.

8. Right to Refuse Service

AMKOR reserves the right to refuse, suspend, or terminate services in cases involving hostile, abusive, threatening, fraudulent, defamatory, discriminatory, or otherwise inappropriate conduct. This includes submission of falsified documentation, harassment of staff, coercive behavior, or attempts to circumvent established policies. In such cases, AMKOR may cancel pending transactions subject to applicable supplier rules and may retain applicable fees as permitted by law.

9. Force Majeure

AMKOR shall not be liable for non-performance or delay caused by events beyond its reasonable control, including but not limited to natural disasters, pandemics, public health emergencies, airline operational disruptions, political unrest, border closures, or government travel restrictions. Remedies, including refunds or travel credits, shall be governed by the policies of the relevant supplier.

10. Limitation of Liability

To the fullest extent permitted by Philippine law, AMKOR’s liability, if legally established, shall be limited to the agency service fees paid for the specific transaction giving rise to the claim. AMKOR shall not be liable for indirect, incidental, consequential, or special damages arising from supplier actions, travel interruptions, visa denials, regulatory changes, or external events.

Nothing herein shall be interpreted as a waiver of mandatory rights under the Civil Code of the Philippines, the Consumer Act of the Philippines (RA 7394), or other applicable laws.

11. Governing Law and Jurisdiction

This Legal Notice and all transactions with AMKOR shall be governed by the laws of the Republic of the Philippines, including but not limited to:

• The Civil Code of the Philippines
• The Consumer Act of the Philippines (RA 7394)
• The Data Privacy Act of 2012 (RA 10173)
• The Electronic Commerce Act of 2000 (RA 8792)
• Applicable Department of Tourism regulations

Any dispute shall be subject to the exclusive jurisdiction of the proper courts of the Philippines.

13. Acknowledgment

By proceeding with inquiries, bookings, submission of personal information, or payment transactions, the client acknowledges having read, understood, and agreed to this Legal Notice and all related policies.
